THE PHILIPPINE LABOR CODE’S OVERHAUL:
ITS PHILOSOPHY AND SCOPE

Abstract

Usec. Josephus Jimenez makes a strong case for the overhaul of Presidential Decree 442,
otherwise known as the “Labor Code of the Philippines”. This overhaul, he emphasizes, is “critical…in order to survive in a new world and win in the global competition.”

Drawing on his vast experience in Labor Law practice – to which he has dedicated himself for
almost 3 decades – Usec. Jimenez then lucidly discussed the substantial and formal defects of the Labor Code; and then concluded with a recommendation that not only corrects the existing defects, but also integrates the proposals given by various legislative think-tanks.
